1. DÉFINITIONS
Cet accord est entre le photographe et le modèle qui atteste être âgé de 18 ans et plus et ne pas être lié avec un tiers par un contrat d’exclusivité sur son image.
2. ENTENTE
Le modèle et le photographe s’entendent pour réaliser conjointement une séance de prise de photo. Le modèle et le photographe, d’un commun accord, décideront des photos à réaliser.
Chacun pourra utiliser les photographies telles que spécifiées dans les points suivants. Le photographe remettra les photographies retenues au modèle dans un délai raisonnable.
Rémunération du modèle ou du photographe : À négocier selon le projet. Note : En TFP, les photos retouchées seront remises au modèle en guise de rémunération.
3. PROPRIÉTÉ INTELLECTUELLE
Les droits d’auteur des photographies demeurent la propriété exclusive du photographe, sans restriction.
4. DROITS D’UTILISATION
Le photographe
Le photographe a le droit d’utiliser les photographies prises lors de la session dont la date est spécifiée ci-dessus pour les supports suivants:
Portfolio personnel et site Internet
Réseaux sociaux dédiés à l’art de la photographie et au partage de contenu créatif (Instagram, Facebook, Twitter, 500px, entre autres, mais pas exclusifs)
Soumission pour compétition avec ou sans rétribution monétaire
Exposition avec ou sans vente de l’oeuvre
Publication dans un livre ou un catalogue artistique pour usage personnel ou pour la vente
Les photographies peuvent être altérées, rognées, publiées seules ou être associées à d’autres contenus visuels, ou textuels dans l’activité naturelle de son travail de photographe.
En aucun temps le photographe ou le modèle ne pourront permettre à un tiers d’utiliser les photographies, qu’il y ait compensation financière ou pas, pour promouvoir un produit ou un service de façon directe ou indirecte sans avoir obtenu au préalable l’autorisation écrite de l’autre partie. Par exemple, le modèle PEUT utiliser les photos pour soumettre sa candidature à une agence de mannequins, mais ne PEUT PAS permettre à une agence de mannequins d’utiliser ces images pour promouvoir le modèle.
En publiant les photographies et lorsque c’est possible et raisonnable, le photographe précisera le nom du modèle et indiquera son site Internet ou profil de réseau social. Le modèle fera de même avec le photographe.
Le modèle
Le modèle a le droit d’utiliser les photos pour son portfolio (site Internet et réseaux sociaux) ainsi que pour sa promotion personnelle (images associées à ses activités professionnelles comme les dates de ses voyages ou les ateliers de photographie auxquelles il participe.
En cas de publications majeures, le photographe doit contacter le modèle afin de lui demander s’il désire être crédité (magazine, livre, etc.). Le modèle a le droit de demander de ne plus être crédité sur les œuvres au format Web et dans la limite des possibilités, si des changements dans sa vie personnelle l’invite à vouloir rester anonyme sur les publications Web.
5. INTÉGRITÉ PHOTOGRAPHIQUE
Le modèle ne peut apporter de modifications aux photographies lors de leurs diffusions (changement de couleur, recadrage, etc.). Par exemple, le modèle n’est pas autorisé à utiliser des «filtres » Instagram / Facebook ou autre pour modifier les images à l’exception de la publication sur Instagram au format carré ou sur une bannière Facebook, auquel cas, le rognage de la photo doit être spécifié et, dans le cas de la censure des réseaux sociaux qui oblige à cacher certaines régions du corps lorsque le nu est concerné.
6. ENTENTE PARTICULIÈRE POUR CETTE SÉANCE
Le photographe et le modèle précisent les éléments suivants :
Le modèle accepte de participer à une séance comprenant lingerie, maillot ou nudité partielle ou intégrale et le fait de son plein gré.
7. ENGAGEMENT DU PHOTOGRAPHE ET DU MODÈLE
Le photographe et le modèle s’interdisent expressément de procéder à une exploitation des photographies susceptible de porter atteinte à la vie privée ou à la réputation des parties ni d’utiliser les photographies, objets de la présente autorisation, sur tout support à caractère pornographique, raciste, xénophobe ou toute autre exploitation préjudiciable.
8. ARCHIVAGE DES FICHIERS NUMÉRIQUES
Le photographe ne peut pas garantir la disponibilité de toutes photographies au-delà de la première date de livraison au modèle.
9. ACCEPTATION DES MODALITÉS
Cette entente doit être considérée comme un contrat fait sous les lois du Canada et de la Province du Québec et toutes intentions doivent être interprétées en totalité conformément avec ces lois. Les parties s’entendent pour élire le domicile du présent contrat dans le district judiciaire de Montréal. En cas de recours judiciaires ou d’arbitrage, le modèle s’engage à rembourser tous les frais assumés par le photographe dans l’éventualité où la cour ou l’arbitre donnerait raison à ce dernier.

This agreement is between the photographer and the model that attests to be 18 years old and over and not be bound with a third party by an exclusive contract on his image.
2. AGREEMENT
The model and the photographer agree to jointly carry out a photo taking session. The model and the photographer, by mutual agreement, will decide the photos to realize.
Everyone will be able to use the photographs as specified in the following points. The photographer will return the selected photographs to the model within a reasonable period of time.

3. INTELLECTUAL PROPERTY
The copyright of the photographs remains the exclusive property of the photographer, without restriction.
4. RIGHTS OF USE
The photograph
The photographer has the right to use the photographs taken during the session whose date is specified above for the following media:
- Personal portfolio and website
- Social networks dedicated to the art of photography and sharing of creative content (Instagram, Facebook, Tumblr, 500px, among others, but not exclusive)
- Submission for competition with or without monetary compensation
- Exhibition with or without sale of the work
- Publication in book or art catalog for personal use or for sale
The photographs may be altered, trimmed, published alone or associated with other visual content, or textual in the natural activity of his work as a photographer.
At no time may the photographer or model allow a third party to use the photographs, whether or not financial compensation, to promote a product or service directly or indirectly without first obtaining the authorization written by the other party. For example, the model MAY use the photos to apply to a modeling agency, but CAN NOT allow a modeling agency to use these images to promote the model .
By publishing the photographs and where possible and reasonable, the photographer will specify the model name and indicate his website or social network profile. The model will do the same with the photographer.
The model
The model has the right to use the photos for his portfolio (website and social networks) as well as for his personal promotion (images associated with his professional activities such as the dates of his travels or photography workshops in which he participates.
In case of major publications, the photographer must contact the model to ask if he wants to be credited (magazine, book, etc.). The model has the right to ask to be no longer credited on works in the Web format and within the limits of possibilities, if changes in his personal life invites him to want to remain anonymous on Web publications.
5. PHOTOGRAPHIC INTEGRITY
The model can not make changes to the photographs during their broadcasts (color change, cropping, etc.). For example, the model is not allowed to use Instagram / Facebook or other "filters" to edit the images except for Instagram posting in square format or on a Facebook banner, in which case, trimming the photo must be specified and, in the case of social networks censorship that requires to hide certain areas of the body when the nude is concerned.

7. ENGAGEMENT OF PHOTOGRAPHER AND MODEL
The photographer and the model are expressly forbidden to proceed with a exploitation of the photographs likely to infringe on the private life or the reputation of the parts or to use the photographs, object of this authorization, on any pornographic support, racist, xenophobic, or any other prejudicial exploitation.
8. ARCHIVE DIGITAL FILES
The photographer can not guarantee the availability of any photographs beyond the first date of delivery to the model.
9. ACCEPTANCE OF TERMS
This agreement must be considered a contract made under the laws of Canada and the Province of Quebec and all intentions must be interpreted in full in accordance with these laws. The parties agree to elect the domicile of this contract in the judicial district of Montreal. In the event of legal recourse or arbitration, the model undertakes to reimburse all the expenses assumed by the photographer in the event that the court or the arbitrator would give reason for the latter.
